A Hong Kong work permit is an integral document that allows you to stay in Hong Kong and work there. The Department of Immigration of Hong Kong SAR of the People’s Republic of China divides all applicants for employment in Hong Kong into two categories

1. Foreign graduates

2. Persons with unique knowledge and skills

Work permit for Hong Kong graduates of foreign origin

Foreign graduates are graduates of full-time accredited educational programs in Hong Kong, who have received an academic degree or a professional qualification and who have foreign citizenship. Thus, studies must take place in Hong Kong at local educational institutions.

During the period of its validity, a work permit gives you the right to legal employment in Hong Kong and the ability to cross the border of the territory multiple times, as well as to legally live in Hong Kong.

Rules for obtaining a Hong Kong work visa for "foreign graduates"

  • Those graduates who need a visa to Hong Kong and who apply to the Immigration Department of the Hong Kong within 6 months after graduation are considered “new graduates” and those who do it later are “returning graduates”. At the time of application, “new graduates” are not required to provide a document confirming their job offer. They can be issued a permit to stay in Hong Kong for a period of 12 months without any other conditions being presented (in fact, this permit is an annual work visa to Hong Kong).
  • “Returning graduates”, on the other hand, are required to provide such confirmation. Their applications will be positively considered if the job (position) they call, as well as the planned monetary remuneration, correspond to generally recognized criteria and practice observed in the labor market in relation to specialists of the same level with them.

The procedure for obtaining a work visa for "foreign graduates"

Applicants must complete visa application form ID 990A. The employing company of the “returning graduates” is required to complete Form ID 990B.

The applicant must submit the following set of documents to the Immigration Department of Hong Kong SAR of the People’s Republic of China:

  • Completed visa application form ID 990A;
  • Your recent photo (must be attached to page 2 of ID 990A);
  • A photocopy of the first page of his international passport, as well as pages containing entry visas to Hong Kong If the applicant is already in Hong Kong, he should also attach a copy of the page with the stamp of the last entry into the SAR;
  • A photocopy of your Hong Kong ID card (if available);
  • A photocopy of the diploma and diploma insert listing the academic disciplines attended by the applicant and the degrees / qualifications received, or a letter from an accredited educational institution in the SAR, confirming the applicant’s degree / qualification during full-time study in Hong Kong.

The applicant’s employing company must submit the following documents to the Hong Kong SAR Department of Immigration:

  • Completed form ID 990B;
  • A photocopy of the employment contract with the applicant or a letter of appointment of the applicant indicating the position, amount of payment and other remuneration, duration of employment;
  • A photocopy of the company’s commercial activity registration certificate; *
  • A photocopy of a document confirming the financial condition of the company (for example, annual accounts, profit and loss account, tax return, etc.); *
  • Detailed business plan (for companies established less than 12 months before the date of application). *

If in the previous 18 months this company has already received a work visa for foreign workers, then the submission of documents marked with “*” is not required.

If the applicant intends to come to Hong Kong with his dependents, then a visa to Hong Kong must be obtained for each of such dependents. For this, the following documents must be submitted to the Department of Immigration of Hong Kong SAR of the PRC:

  • Main applicant visa application form ID 990A with part B completed by the dependent;
  • A recent photograph of the dependent (must be attached to page 2 of ID 990A);
  • A photocopy of the first page of the dependent’s international passport, as well as the pages containing the entry visas for Hong Kong (if any). If the dependent is already in Hong Kong, they should also attach a copy of the page stamped with the date of their last entry into the SAR;
  • A photocopy of documents confirming the relationship / legal relationship of the applicant with the dependent – marriage certificate, birth certificate, family photos, etc. (documents must be officially translated into English).

All specified forms / questionnaires must be duly completed and signed. If the applicant is accompanied by dependents less than 16 years old, or the applicant himself is less than 16 years old, then the application form for such a dependent or applicant is required to be signed by his / her parents.

The questionnaires and all accompanying documents must be submitted in person (or through a proxy) or sent by mail to the Immigration Department of the Hong Kong SAR of China.

In case of a positive result of the consideration of the application, the corresponding visa sticker must be collected from the Immigration Department of the Hong Kong SAR of the PRC personally to the applicant or with the help of an authorized representative. If the applicant is outside Hong Kong, it will be sent to him by certified mail. The sticker should be placed on the free page of the passport and presented to the border control officer at the entrance to Hong Kong.

4 weeks before the expiration of the current work visa, “foreign graduates” are eligible to apply for an extension of their residence permit in the Hong Kong SAR of China. They are required to submit to the Immigration Department a document confirming a job offer made by them that meets the generally recognized criteria and practices observed in the labor market for specialists of the same level as them. Those of the applicants who, during their stay in Hong Kong, opened their own business or entered a partner in any commercial enterprise, must provide evidence of the existence and conduct of such a business. Usually the Department of Immigration of Hong Kong SAR, China, extends work visas, first for 2 years, then again for 2 years. For the third time, a work visa to Hong Kong has been extended for 3 years.

Work visa holders who fall into the category of “foreign graduates” during the period of its validity have the right to change their place of work without seeking prior permission from the immigration authorities of the SAR.

When submitting documents to the diplomatic mission of the PRC or to the Immigration Department of the Representation of the Government of the Hong Kong SAR of the PRC in Beijing, the time and form of payment are set individually by these bodies.

 

  • The visa fee is HK $ 160.

It is also possible to personally submit the questionnaires and all accompanying documents, including a foreign passport, to the diplomatic mission of the Peoples Republic of China in your country. Foreigners working and / or permanently staying on the territory of mainland China have the right to contact the Immigration Department of the Representative Office of the Government of the Hong Kong SAR of the PRC in Beijing.

Extension of the working permit in Hong Kong

Individuals admitted to work in Hong Kong under the General Employment Program are eligible to apply for an extension of their residence permit in Hong Kong 4 weeks before the expiry of their current work permit. Such an application will be considered only if the applicant still fully meets the requirements of the Program. Usually, the Department of Immigration of Hong Kong SAR, extends work permits, first for 2 years, then again for 2 years, and then for 3 years, or within the scope of the applicant’s travel contract.
